Terms and Conditions for EthMail (UK)

Effective Date: 24 October 2025

These Terms and Conditions (“Terms”) govern your access to and use of EthMail (the “Services”), operated by EthMail Ltd, a company registered in England and Wales under company number 12345678.

By creating an account or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

1. Acceptance of Terms

These Terms, together with our Privacy Policy (available at ethmail.com/privacy), form a legally binding agreement between you and EthMail Ltd. We may update these Terms from time to time. We will notify you of material changes via email or in-app notice at least 30 days in advance. Continued use after changes constitutes acceptance.

2. Eligibility

You must be at least 13 years old and resident in the United Kingdom or another jurisdiction where the Services are legally available. By using the Services, you confirm you meet these requirements and have full legal capacity to enter into this agreement.

3. Account Registration & Security

  • You must provide accurate, complete registration information.

  • You are responsible for maintaining the confidentiality of your password and for all activity under your account.

  • Notify us immediately at security@ethmail.com of any unauthorised use.

We reserve the right to suspend or terminate accounts for breach of these Terms or suspected fraud.

4. Your Use of the Services

4.1 Permitted Use

You are granted a limited, non-transferable, revocable licence to use the Services for personal or internal business purposes in compliance with UK law.

Prohibited activities include:

  • Sending spam, phishing, or unlawful content.

  • Using the Services to infringe copyright, trademarks, or privacy rights.

  • Attempting to interfere with, hack, or disrupt the Services.

  • Using automated tools (bots, scrapers) without prior written consent.

4.2 AI Features

EthMail uses AI (powered by Google infrastructure) for summarisation, reply suggestions, and smart filtering. You acknowledge that:

  • AI outputs may be inaccurate, incomplete, or biased.

  • You must verify all AI-generated content before relying on it.

  • EthMail is not liable for decisions made using AI tools.

5. User Content

You retain ownership of content you send, receive, or store (“User Content”). By using the Services, you grant EthMail a worldwide, royalty-free licence to host, process, and transmit your User Content as needed to deliver the Services.

You are solely responsible for ensuring your User Content complies with UK law, including the Communications Act 2003, Malicious Communications Act 1988, and Data Protection Act 2018.

We may remove or suspend access to any User Content that breaches these Terms or applicable law.

6. Pricing & Payment (UK)

  • Free and paid plans are available as advertised on ethmail.com/pricing.

  • All prices are in GBP (£) and include VAT where applicable.

  • Payments are processed via secure UK-regulated payment providers.

  • You may cancel paid subscriptions at any time with 30 days’ notice. No refunds for partial months.

We reserve the right to change pricing with 30 days’ notice.

7. Privacy & Data Protection

Your data is processed in accordance with the UK GDPR and Data Protection Act 2018. See our Privacy Policy for full details on:

  • How we collect and use your data.

  • Your rights (access, rectification, erasure, etc.).

  • Data retention and international transfers.

We use Google Cloud (UK region) for primary data storage to ensure compliance with UK data residency preferences.

8. Intellectual Property

EthMail” and our logo are registered trademarks in the UK (UK000038xxxxx). All software, designs, and content (excluding User Content) are protected by copyright and owned by EthMail Ltd.

9. Third-Party Services

The Services integrate with Google and other providers. Your use of such integrations is subject to their terms. We are not responsible for third-party downtime, data practices, or service changes.

10. Disclaimers

The Services are provided “as is” and “as available”. We do not warrant that:

  • The Services will be uninterrupted or error-free.

  • AI features will be accurate or suitable for your needs.

To the fullest extent permitted by UK law, we exclude all implied conditions, warranties, or terms.

11. Limitation of Liability

Nothing in these Terms excludes liability for:

  • Death or personal injury caused by negligence.

  • Fraud or fraudulent misrepresentation.

  • Any liability under the Consumer Rights Act 2015.

Subject to the above, EthMail Ltd shall not be liable for:

  • Loss of profits, revenue, goodwill, or data.

  • Indirect, consequential, or special losses.

  • Any loss arising from AI-generated content.

Our total liability shall not exceed the greater of:

  • £100, or

  • The total fees you paid in the 12 months before the claim.

12. Termination

  • You may close your account anytime via Settings.

  • We may suspend or terminate your access immediately if you breach these Terms or engage in illegal activity.

  • Upon termination, your data will be deleted within 30 days unless required longer by law.

13. Governing Law & Jurisdiction

These Terms are governed by the laws of England and Wales. Any dispute shall be subject to the exclusive jurisdiction of the courts of England and Wales, unless you are a consumer resident in Scotland or Northern Ireland, in which case you may also bring proceedings in your local courts.

14. Consumer Rights (UK Residents)

If you are a consumer, nothing in these Terms affects your statutory rights under the Consumer Rights Act 2015, including your right to services performed with reasonable care and skill.

You have a 14-day right to cancel paid subscriptions from the date of purchase (cooling-off period), unless you have already used the Services.

If unresolved, UK consumers may use the EU Online Dispute Resolution platform (even post-Brexit, accessible via UK government guidance).

16. General

  • Severability: If any part is unenforceable, the rest remains valid.

  • No waiver: Failure to enforce a right does not waive it.

  • Assignment: We may assign these Terms; you may not without consent.
